PUBLIC HEARING – AMEND LL #3-2016 DOG LICENSING AND CONTROL LAW
Mr. Yates brought the hearing to order at 6:45 PM.
Mr. Yates asked what we were changing in the dog law.
Mrs. Gibbs said we are changing the license, impoundment, and enumeration fees, adding the definition for service animal, and adding a 3-year option to license terms.
Mr. Yates asked if there were any comments or concerns about changing the law.

Mrs. Emick said she would like to request an extra speed zone sign placed in the middle of Lakeland or as you turn around the corner. She said they have a few new people on the road, and they don’t know to slow down and that there are little kids running around.
Mr. Yates asked if they could place a kids at play sign.
Mr. Karlson said they can’t put a children at play but they can put a warning or slow down sign.
Mr. Thomas said the Harmony Historical Society is looking good.
Mr. Henck asked if there can be a stop sign placed coming out of lakeside camping.
Mr. Yates said he would look into it.

Mr. Yates said agriculture and markets sent a letter stating they are cancelling contracts for municipalities, and we need to come up with a plan in 30 days.

- WESTERN NEW YORK ECONOMIC COUNCIL – LOI for Round 6 of the NYS Downtown Revitalization Initiative
Mr. Yates said we are paying off the mortgage for the New Town Building.
Mrs. Thomas asked what the principal and interest is.
Mr. Yates said the principal payment was $320,000.00 and the interest was 2.9% totaling $9,254.22.
MRS. ORTMAN MOTIONED TO MAKE THE FINAL BAN PAYMENT IN THE AMOUNT OF $329,280.00 ON THE NEW TOWN BUILDING. MR. SENA SECONDED. YES (5): SENA, PFEIL, YATES, ORTMAN, SENSKE. NO (0). THE MOTION WAS CARRIED
Mr. Senske said they met with Harmony, and they agreed in principle to the details and they are hoping to meet New York State guidelines. He said there will be some savings to the Town of Harmony and some revenue to the Town of North Harmony. Mr. Senske said the Town of Harmony still must maintain all their court records so they have to receive all of the fines and we will charge a fee to use our court system. He said in the next few months they must have a joint board meeting with Harmony and North Harmony to set the resolutions.
Mrs. Ortman said they will also have to have a joint hearing with the two towns.
Mrs. Thomas asked if they will still have their judge.
Mr. Senske said no we will use our judge and clerks.
Mr. Yates said their caseload is not large.
Mrs. Ortman said one judge will be elected and they can be from North Harmony or Harmony.
- NEW BUSINESS
Mr. Yates said when town employees are called and can leave the town would like to let them leave and pay their time. He said right now there is only one employee that is a part of the fire department.
Mr. Yates said after speaking to a professional they think installing sound board in the court room should resolve the sound problem, but they can also invest in a remote system with mics and a couple ceiling mounted speakers. He said with the boards favor he would like to look into a system and get some prices. He said he will get the prices and bring it back to the board.
Mr. Pfeil asked if we could get shades for the back windows so he can see the audience when the sun is coming through.
MRS. ORTMAN MOTIONED TO AUTHORIZE THE SUPERVISOR TO LOOK INTO GETTING A SOUND SYSTEM FOR THE COURT ROOM. MR. PFEIL SECONDED. YES (5): SENA, PFEIL, YATES, ORTMAN, SENSKE. NO (0). THE MOTION WAS CARRIED
Mr. Yates said Mrs. Gibbs will be moving into Mrs. Thomas position as she is now so we will need to assign a third signature card holder and since Mr. Pfeil is close and available, he would like to make him the third signature card holder to get checks signed in a timely manner. He said Mrs. Gibbs is not elected so cannot be a signature cardholder.

Mr. Yates asked what LSG-1 is.
Mrs. Gibbs said it the MU-1 schedule manual that gives guidance on how long records are kept before being destroyed and what is kept permanently.
Mr. Yates asked if we must run this by anyone or do we just follow the guidelines.
Mrs. Gibbs said she follows the guidelines, records the documents and has a witness sign before destroying.

TOWN OF NORTH HARMONY
ASSESSOR’S REPORT
August 2022
In August we’ve been working on filing the school assessment rolls with Chautauqua Lake, Panama, and Sherman School Districts. They will use the assessment roll to calculate their school tax rates for each municipality for the upcoming September school tax. We have also forwarded a final copy of the Town of North Harmony Assessment roll to the County Real Property Tax Service for their office to produce the school tax bills.

COURT REPORT FOR THE MONTH OF
July 2022
$36,484.00 in fines, fees, and surcharges was collected by the Court and was given to the Town of North Harmony CFO for the court cases reported to the NYS Comptroller for July 2022. We opened 342 new cases and closed 215 cases.
BEN KARLSON, DEPUTY HIGHWAY SUPERINTENDENT
Mr. Karlson said due to logging jobs on Stebbins Rd. they postponed paving Stebbins Rd. until later in the fall. He said the new truck he got authorization to build will be built in October. Mr. Karlson said a new black top job on Potter Rd. was damaged by a farmer to the point that it will need repaired. He said the individual is willing to pay for the repair but understands the town can’t charge him for repairs. Mr. Karlson asked how he legally deals with this situation.
Mr. Yates said we cannot charge for services.
Mrs. Johnson said to contact her so they can review the situation.
Mr. Yates said that the town is having a lot more unauthorized dumping at the highway building. He said he believes it would be to the towns benefit to put security cameras on the backside of the building facing the fuel pumps, on the front side of the building facing the road and one facing the transfer station. He said he would like to just see about the cost.
Mr. Karlson said the way fuel costs are right now it would benefit having one facing the pumps.

BRAD LAWSON, ZONING CEO (Copy of Report in Minute Book)
Mr. Lawson said the Planning Board is meeting on Tuesday, August 9th at 7:00 PM to discuss the Tri-James gravel pit on Open Meadows Rd. He said with all the infrastructure coming to the Stow
intersection he suggests the Town Board putting together a planning commission separate from the Planning Board. Mr. Lawson said the Planning Board is doing other things.
Mrs. Johnson said the Planning Board was working on the Route 394 intersection with Mr. McCord but since then Mr. McCord has stepped down. She said she recommends the town hiring a planner to help with that intersection.
Mr. Sena said he received a call from a resident claiming there was going to be a solar farm going on the old Woodcrest Golf Course.
Mr. Lawson said it could. He said they were looking at a 200-400acre solar farm. He said he has not heard back from them, but several residents have been approached by them to sign leases. He said it is in the right district, but he doesn’t know anything more about it.
