Mr. Levesque opened the hearing at 7:00 P.M.
Mr. Stapleton swore in all who expressed intent to speak regarding the cases before the board.
Mr. Levesque motioned to accept the minutes of the 4/24/2019 ZBA Hearing as submitted by the Clerk. Mr. Ortman seconded, and the motion was carried unanimously.
- Brian & Kim Baker requesting a Special Permit to construct a 26’x22’ roof over a recreational Vehicle and deck at property owned by Robert Kanouff, Lakeside Camping, 3280 Hadley Bay Rd., in the R-4 District, Section 332.20-1-35, Lot #128.
Mr. Kanouff, owner of the campground, appeared to represent Mr. and Mrs. Baker. Mr. Kanouff said they are doing the same as they always have been just a little smaller than the last one.
Mr. Levesque motioned to grant a special permit to Brian and Kim Baker to construct a 26’x22’ roof over a recreational vehicle and deck at property owned by Robert Kanouff, Lakeside Camping, 3280 Hadley Bay Rd., in the R-4 District, Section 332.20-1-35, Lot #128 as outlined in the application and these minutes. Mrs. Emick Seconded, and the motion was carried unanimously.
- Ashville Free Library requesting an Area Variances to construct an addition closer to setbacks than allowed in Zoning in the R-1 District at property located at 2200 N. Maple Ave., specifically Sec. 384.11-1-94.2; 384.11-1-94.3; 384.11-1-95.
Mr. Radka and Mr. Butler appeared to represent the Ashville Free Library. Mr. Butler said they ran out of space so they would like to add on. He said one side will be heated which would be the work room and the other side will not have heat which is the storage room. It will be added on in the back and is 6.2’ from the rear property line and 13’ from the side property line. Mr. Radka said currently there is a storage shed that will be remove that is about 8×12. Mr. Leveque said that we will be adding on to an existing variance that is already closer to the setbacks than zoning allows. Mrs. Fuller had some concerns about the addition butting up to her land. Mrs. Fuller said she donated land to the library but didn’t know they had plans of adding on. Mr. Leveque said that as of now the existing shed comes out 14 ft from the library and the add on will not be any closer than the existing shed. Mrs. Fuller said she doesn’t have a problem with it if it isn’t any closer. Mr. Radka said the siding will be the same as the rest of the library, it will be attached to the library with a single lean-to roof with gutters and there will be no pluming in the addition. Mr. Lawson said they were under the 25% coverage amount. The board reviewed Zoning Code Sec. 904 Use and Area Variances; C.2. questions a.) no b.) no c.) yes d.) no e.) yes
Mr. Levesque motioned to grant area variance to the Ashville Free Library to construct an addition closer to setbacks than allowed in Zoning in the R-1 district at property located at 2200 N. Maple Ave., Specifically Section 384.11-1-94.2; 384.11-1-94.3; 384.11-1-95 as outlined in the application and in these minutes. Mr. Vaillancourt seconded, and the motion was carried unanimously.
Mr. Lawson said that the board waved all fees if approved.
On a motion made by Mr. Leveque, seconded by Mr. Vaillancourt, and with none being opposed the hearing was adjourned at 7:30PM.
