Mr. Levesque brought the hearing to order at 7:35 PM.
Mr. Levesque motioned to adopt the minutes of the 9/26/2018 ZBA Hearing as presented by the Clerk. Mr. Thomas seconded, and the motion was carried.
- Michael & Kimberly Peccia (re-hear ref. 9/26/18 minutes) requesting Area Variances to construct an addition closer to roadside setbacks than allowed in the R-1 District at property located at 3618 Watson Rd., Stow, Specifically Section 332.16-1-21. Requested is an additional 2’ toward road.
Mr. Levesque asked Mr. Peccia if he understood correctly that he just wishes to add 2’ to the 4’ on the roadside setback from the variance granted at the 9/26/18 hearing. The dimensions of the mud room will be 6’ long x 10’ wide. It was discussed that the original application was just modified for the purposes of this Hearing. It was noted that Mr. Peccia’s application was to have been heard at the November 2018 meeting but was cancelled due to weather. It was discussed at length and determined by the board that the distance from the addition to the roadside is within the 50’ setback allowed. It was further discussed that the actual variance is for the side setbacks for the 2’ additional request. Mr. Levesque asked if anyone wished to speak regarding the application.
Mr. Levesque motioned to grant an Area Variance (modification of the 9/26/18 application of 2’ Extension of the 4’ x 10’ mudroom to 6’ x 10’) for side setbacks as submitted in his 11/28/18 and 2/27/19 applications, to Michael and Kimberly Peccia’s property located at 3618 Watson Rd., Stow, Specifically Section 332.16-1-21. Mr. Thomas seconded, and the motion was carried.
James & Barbara Fox requesting Area Variances to construct a garage addition closer to side and roadside setbacks than allowed in the R-1 District at property located at 3898 Parkway, Specifically Section 332.05-2-12.
Mr. Fox said they wished to construct a single car garage addition onto their existing garage as they will become full time residents soon and need the space. The addition will be 2 story and Mr. Fox said they have no intent to create habitable space in the structure. Mrs. Emick asked if the entrance door on the house will stay the same. Mr. Fox said the entrance door will now be facing the neighbors to the south and will have a small portico to get out of the weather. The side setback requested is 4.3’ from the property line and will be not be increased from the existing house setback. The distance from the structure to the road will be 36’. Mr. Levesque asked if anyone wished to speak regarding the application. Mr. Thomas asked how many additional feet toward the road the new addition would increase from the old garage. Mr. Fox said 16’ further. It was also discussed that the road, Parkway, is a private road. Mr. Fox said they intend to discuss drainage with Mr. Lawson and have thoughts of installing a rain garden.
Mr. Levesque motioned to grant Area Variances to James & Barbara Fox to construct a garage addition 4.3’ from the side setback and 36’ from the roadside edge, which is closer than allowed in the R-1 District at property located at 3898 Parkway, Specifically Section 332.05-2-12 with the following condition:
- No habitable space be created in the addition
- Drainage plans must be submitted to CEO and approved
Mrs. Emick seconded, and the motion was carried.
On a motion made by Mr. Levesque, seconded by Mr. Vaillancourt and with none being opposed, the hearing was adjourned at 7:30 PM.
