Mr. Levesque brought the hearing to order at 7:00 PM. Mr. Stapleton swore in all who expressed intent to speak at the hearing.
Mr. Levesque motioned to approve the 1/25/18 ZBA minutes as presented by the Clerk. Mr. Thomas seconded, and the motion was carried unanimously.
- Vincent Freeman requesting an Area Variance for height to construct an addition to a barn at property located in the R-1 District at 3014 Rt. 394, Ashville, Specifically Sec. 350.13-1-46.
Mr. Freeman said the lower elevation of the existing portion of the old barn is at 22.6’ and then the new construction comes up 2’ or 20.5 3/8’. He said the current height of the existing barn is 17.8’. Mr. Levesque noted that the increase will be absorbed in the peak. Mr. Freeman said the addition is 58’ long and 27.6’ wide. He said the barn will be for storage for his wife (tractor and yard equipment). Mr. Freeman provided a quit claim deed to add 30’ to the rear of his property for setbacks. He said this was a part of a separate lot that he owns. There was general discussion of the lay of the land in relation to elevation. Mr. Levesque clarified that ridge line of the old section is 17.8’ and the new portion will be 22.6’ at the open drive through area; and 20.5 3/8’ for the rest of the addition. Mr. Levesque asked if anyone wished to speak regarding the application. Mr. Levesque reviewed Zoning Code Section 904 C. Area Variances 2. a) no b) yes c) yes d) no e) yes. It was stated for the record that the barn will be located in the rear of the property which is approximately 7 acres of vacant land and there will be no Commercial use of this building as it is in the R-1 District. Mr. Freeman said the barn will have electric but there will be no water; no sewer; and there is no intent to create living space.
Mr. Levesque motioned to approve the application of Vincent Freeman requesting an Area Variance for height to construct an addition to a barn at property located in the R-1 District at 3014 Rt. 394, Ashville, Specifically Sec. 350.13-1-46 as outlined in his application and these minutes. Mrs. Emick seconded, and the motion was carried unanimously.
- Kyle Crandall requesting an Area Variance for height to construct a barn at property located in the R-2 District at 2392 North Maple Ave., Ashville, Specifically Sec. 367.00-2-21.
Mr. Shelters, Contractor appeared to represent Mr. Crandall the applicant. Mr. Shelters said the Crandall’s would like to construct a 45’ x 50’ pole barn with a peak height of 24’ (18’ is allowed) to store their Recreational Vehicle’s and camper in. He said the reason for the height of 24’ is because the doors will be 14’ to accommodate the RV. Mr. Thomas asked if any neighbors views will be impeded. Mr. Shelters said there are photos of the property and neighboring properties and he does not believe any views will be affected. He said there will be no septic; no habitable space; and no electric initially. He said they do plan for electric at some point. Mr. Lawson said that there is not enough detail on the drawings and the applicant did not want to get plans until they knew if their application would be approved. He said he would need to work with the applicant on those details. Mr. Lawson said a site plan had been provided because he was concerned about runoff. Mr. Levesque asked if formal plans and drainage plans would be submitted to Mr. Lawson. Mr. Lawson said they will have French drains around the building for runoff which will go to the seepage pit they have already. Mr. Levesque asked if anyone wished to speak regarding the application. Mr. Levesque reviewed Zoning Code Section 904 C. Area Variances 2. a) no b) no c) yes d) no e) yes.
- Levesque motioned to approve the application of Kyle Crandall requesting an Area Variance for height to construct a 24’ tall pole barn at property located in the R-2 District at 2392 North Maple Ave., Ashville, Specifically Sec. 367.00-2-21 as outlined in his application and in these minutes. Mr. Winger seconded, and the motion was carried unanimously.
The hearing was adjourned at 7:45 PM.
