Mrs. Carlson brought the Special Meeting to order at 11:00 AM. She said Steve Abdella at the County has indicated that the next step in the sewer district extension process to the west side of the lake is State Comptroller approval. This requires that the County Legislature and the Town Board adopt “resolutions of intent” whereby the County District will accept the transfer of Town District facilities that lie within the County District extension area. Mrs. Carlson said this would be the sewer lines that the town purchased during the Sunrise Cove/BOCES extension.

ON A MOTION MADE BY MR. MCNEILL THE FOLLOWING RESOLUTION OF INTENT TO TRANSFER TOWN OF NORTH HARMONY SEWER DISTRICT FACILITIES AND PROPERTY INTERESTS TO THE COUNTY FOR THE EXTENSION OF THE SOUTH & CENTER CHAUTAUQUA LAKE SEWER DISTRICT WAS ADOPTED. FURTHER, THE SUPERVISOR WAS AUTHORIZED TO SIGN ANY AND ALL AGREEMENTS/DOCUMENTS TO FACILITATE THE ACTION. MRS. ORTMAN SECONDED. YES (4): STOW, MCNEILL, ORTMAN, CARLSON. NO (0). THE MOTION WAS CARRIED.
Resolution of Intent to Transfer Town of North Harmony Sewer District Facilities and Property Interests to the County for the Extension of the South Chautauqua Lake Sewer District
WHEREAS, pursuant to Resolution 264-17 of the Chautauqua County Legislature, the County Legislature determined it was in the public interest to extend the South Chautauqua Lake Sewer District (the “County District”) through the Hamlet of Stow on the west side of Chautauqua Lake; and
WHEREAS, the extension of the County District will include an area currently served by a Town of North Harmony Sewer District (the “Town District”), and such area will be converted from being a Town District service area to a County District service area; now therefore be it
RESOLVED, that it is the intent of the Town of North Harmony that upon the completion of the County District extension, the Town of North Harmony shall transfer to the County District all necessary Town District facilities and property interests in order to serve the portion of the County District extension area that will be converted from being within a Town District to being within a County District; and be it further
RESOLVED, that the Town Supervisor of the Town of North Harmony is authorized to execute all necessary agreements and documents to effectuate the intent of this resolution.
There was brief discussion of the payment of the BAN note for the purchase of the water/sewer lines by the town from Dr. Galiel of Sunrise Cove (current principal $50,478 due to be paid off in 2021).
