Mr. Levesque brought the hearing to order. Mrs. Thomas swore in all who expressed intent to speak regarding the case before the board.
- Thomas Anzalone requesting a Special Use Permit to construct a 40’ x 100’ boat storage building in the I-L District, at property located at 3617 Panama-Stedman Rd., Specifically Sec. 331.00-1-17 which does not conform with Sec. 402, Uses Permitted.
Mr. Levesque asked Mr. Anzalone what he wished to do. Mr. Anzalone said he would like to install a 40’x100’ pole barn for boat storage on his property located in the Light Industrial District. There was discussion that the current access is directly across from Open Meadows Rd. It was discussed that Mr. Anzalone has done some fill and grade work on the land in question. Mr. LaPorte owns property behind and to the left of Mr. Anzalone’s property and asked about the uses in the Light Industrial zoning. Mr. Lawson explained that there are many uses and they can be found in our Zoning Code on the Town’s website. There was discussion that if Mr. Anzalone wished to establish a commercial enterprise at the location, he would have to go through a much more extensive process involving the Planning Board and Town Board. Mr. Anzalone said that the current location of their business in Mayville is owned by Webb’s and if for some reason they have to move, they may look further at the location for their business premises in the future. Mr. Lawson gave some background on the property. He said previously the land was owned by Mr. Gooch who had proposed to build storage structures there. He said Mr. Gooch passed away before this happened and Mr. Anzalone bought the land. Mr. Anzalone came to the Planning Board with a site plan review to fill in and grade the land with fill from the Chautauqua Institution Amphitheatre. Mr. Lawson said in the Light Industrial district you can build a storage building by right, but if it is for a new building for boat storage, it requires a Special Permit. Mr. Anzalone said they do not intend to install electric, water or sewer at this time. The building will have a gravel floor. He said they plan to begin construction in late summer or early fall. Mr. Lawson said the town attorney had seen no problems with the application either logistically or legally at this time. After discussion, it was determined that there are no issues with ingress and egress with the present plan. Mr. Levesque asked if anyone wished to speak regarding the application.
Mr. Levesque motioned to grant a Special Use Permit to Thomas Anzalone to construct a 40’ x 100’ boat storage building in the I-1 District, at property located at 3617 Panama-Stedman Rd., Specifically Sec. 331.00-1-17 which does not conform with Sec. 402, Uses Permitted. Mr. Thomas seconded. The motion was carried unanimously.
