Mr. Levesque brought the hearing to order at 7:00 PM. Mr. Stapleton swore in all who expressed intent to speak regarding the cases before the board.
Mr. Levesque motioned to accept the minutes of the 10/26/2016 ZBA Hearing as submitted by the Clerk. Mr. Ortman seconded and the motion was carried unanimously.
Marya Johnson requesting a Special Permit to build a fence along the property line higher than allowed by zoning located at 6335 Magnolia-Stedman (Stedman Café), Specifically Sec. 314.00-2-11
Ms. Johnson explained that they would like to put a privacy fence 2’ from the property line between Joe Johnson and her own property. Ms. Johnson said the fence was 10’ tall, but almost two feet of it will be down in the ditch. Ms. Johnson said it would not prevent water flow and it will be raised a little to allow them to be able to maintain the ditch. Mr. Lawson explained that the fence needs to be attractive on both sides. Mr. Stahlsmith said he is using concrete for the bottom of the poles and metal brackets and treated 4x4s and they will be staining it. Ms. Johnson said the same contractor that has been doing their other jobs will be doing this one. Mr. Stahlsmith wants to stick to the old look. Mr. Stapleton asked if there has been any conflict with the neighbors over the other projects. Ms. Johnson said that they have not had any problems recently from the neighbors.
Mr. Levesque motioned to grant a Special Use Permit to Mayra Johnson to build a fence along the
Deputy Town Clerk property line higher than allowed in Zoning Code at property located at 6335 Magnolia-Stedman (Stedman Café), Specifically Sec. 314.00-2-11. Mrs. Emick seconded. The motion was carried unanimously.
There will not be a ZBA hearing for the month of December.
The hearing was adjourned at 7:20 PM
