Mr. Levesque brought the hearing to order at 7:00 PM. Mr. Stapleton swore in all who expressed intent to speak regarding the cases before the board.
Mr. Winger motioned to accept the minutes of the 8/24/2016 ZBA Hearing as submitted by the Clerk. Mr. Levesque seconded and the motion was carried unanimously.
Mr. Levesque motioned to accept the minutes of the 9/28/2016 ZBA Hearing as submitted by the Clerk. Mr. Thomas seconded and the motion was carried unanimously.
Richard & Yvette Jordan requesting an Area Variance to place a 10’x14’ storage structure closer to setbacks than allowed in Zoning Code at property located at 79 Goose Creek Rd., Ashville, NY, specifically Sec. 367.15-1-43.
Mr. Jordan explained that they would like to place a 10’x14’ storage shed on skids 2’ from the north side setback (10’ required) and 25’ from the road edge (50’ required) on their property located on Goose Creek Rd. in Loomis Bay. Mr. Jordan said the reason for the location of the shed at that particular spot was at the request of neighbors so that it does not interfere with their view of Goose Creek and the lake. He said there is a manhole cover for the sewer located on the lot about 15’ from the front corner of the proposed shed. It was noted that there are both sewer and water services there. Mr. Jordan said there were no objections from his neighbors Morgan’s, Sopko’s or Yeager’s. It was noted that the Jordan’s own several lots in Loomis Bay and the shed will be located on a lot that adjoins the lot that their home is on. There was general discussion of the pros and cons of joining smaller non-conforming lots to create larger or conforming lots. Mr. Levesque asked if anyone wished to speak regarding the application. Mr. Levesque read Zoning Code SECTION 904 – Use and Area Variances C. Area Variances 2. Questions (a) thru (e). Questions were answered as follows: (a) no (b) yes (c) yes (d) no (e) yes.
Mr. Levesque motioned to grant an Area Variance to Richard & Yvette Jordan to place a 10’x14’ storage structure closer to setbacks than allowed in Zoning Code at property located at 79 Goose Creek Rd., Ashville, NY, specifically Sec. 367.15-1-43, as outlined in their application and these minutes. Mrs. Emick seconded and the motion was carried unanimously.
- The Town of North Harmony requesting a Special Permit to place an 8’x4’ (32 sq. ft.) sign at Veterans Park located at 2239 N. Maple, Ashville, NY, specifically Sec. 384.06-1-27, which does not comply with Section 617 of the Zoning Code.
Mrs. Thomas said she would represent the Town for this application. She said Veteran’s Park is located at the “V” on Fardink and North Maple. She said the town would like to place the sign between the

utility pole on Fardink Rd. and the sidewalk, approximately 15’ from the road edge on Fardink Rd. and angle it so that it will also be visible from North Maple. She said they are requesting a 32 sq. ft. sign and the law only allows for 25 sq. ft. Mrs. Thomas said the sign will be white with black lettering “Town of North Harmony Veterans Park” and will have a silhouette of a soldier on it. Mr. Levesque asked if anyone wished to speak regarding the application. Mrs. Thomas said the Veterans Committee has been working to raise funds for this project for almost 5 years. She said hopefully the granite walls will be placed soon. She also invited all ZBA members to attend the dedication ceremony on 11/11/2016 at 1:00 PM.

The ZBA hearing for November will be held on 11/30/16; December will be held on 12/14/16.
