Mr. Rice opened the hearing at 7:00 PM.
Dick Sena gave report from the Town Board Meeting (see September Town Board Meeting minutes). Mr. Lawson, Zoning C.E.O. gave report.
The Planning Board of the Town of North Harmony will hold a SEQR and Site Plan Review on an application to strip and fill in a portion of property owned by Thomas Anzalone and located at 3617 Panama-Stedman Rd. (Specifically Sec. 331.00-1-17) in the Light Industrial District.
Mr. Johnson motioned that the Planning Board take lead agency status on the SEQR application of Mr. Anzalone. Mr. Rieg seconded. YES (6) Rice, Johnson, Geist, Warner, Rieg, Strand. NO (0). The motion was carried.

Mr. Anzalone said he just wanted to take advantage of free dirt given to them from the amphitheater excavation at the Chautauqua Institution to fill in a dip on the property to make it usable property.
Mr. Anzalone said it would not change where any of the water goes and that there are no neighbors near. The closest neighbor is about a half a mile.
Mr. Lawson said there are not any erosion issues. Mr. Lawson said when they bring the dirt in they have to make sure it is compacted and leveled off to make sure they do not cause any erosion.
Mr. Anzalone said they will be pushing the existing top soil off and once the dirt is put down they will be replacing the top soil.
The board reviewed part one, project information. There was a correction made to question 3b from 5 acres to about 1 ½ acres and Industrial was added to question 4.
The board Reviewed part 2-impact assessment.
Mr. Rieg motioned for a Negative Declaration of environmental impact for Mr. Anzalone’s proposed project. Mr. Johnson seconded and the motion was carried unanimously.
Mr. Warner motioned to grant a permit to Mr. Anzalone to level the ground at property located (331.00-1- 17) 3617 Panama-Steadman Road Mayville, NY 14757 Mr. Geist seconded and the motion was carried unanimously.
The hearing was adjourned at 7:30 PM.
