Mr. Levesque opened the hearing at 7:00 PM. Mrs. Thomas swore in all who expressed intent to speak regarding the application before the board.
Mr. Thomas motioned to adopt the minutes of the 7/27/16 Zoning Board of Appeals Hearing as presented by the clerk. Mr. Vaillancourt seconded and the motion was carried unanimously.
- Donald Juliano requesting a Special Use Permit to construct a roof over a travel trailer at property owned by Robert Kanouff and known as Lakeside Campground, located at 3280 Hadley Bay Rd., Lot #90, Specifically Section 332.20-1-35.
Mr. Levesque asked Mr. Juliano what he wished to do. Mr. Juliano said he would like to put a roof over a porch and travel trailer which would be 33’ long x 20’ wide and approximately 12’ at the peak of the roof. He indicated the porch would have rails, but no walls or enclosures and no habitable space would be created. Mr. Levesque asked if anyone wished to speak regarding the application.
Mr. Levesque stated that a meeting of the Zoning Board Appeals held in April, 2016, Mr. Kanouff had been required to number the lot sites and put up street name signs at the campsite. He asked Mr. Kanouff if that had been completed. Mr. Kanouff said no. Mr. Levesque asked when he felt this would be accomplished. Mr. Kanouff said he had 5 sign posts set and some tenants had suggestions of what to name the roads. He said he is getting some of the signs made by some friends. Mrs. Emick asked if he had a completion date. Mr. Kanouff said he has no idea. There was discussion that on 4/27/16 at the ZBA hearing, Mr. Kanouff had been given 30 days to comply with the street sign request. Subsequently, he applied for and received a 30 day extension. The board noted it is now approximately 120 days since the requirement was mandated. Mr. Kanouff said he intends to comply, but his priorities and the boards are different. He said he had 3 tenants who abandoned their sites and he had to clean them up and that was a larger priority than putting up the signs. Mr. Levesque said that when a fireman has to go there on an emergency call it is imperative that they be able to locate the site of the call. Mr. Levesque said the requirement of the street signs is for the safety of the community and the people who live there and for the emergency responders. Mrs. Emick said the board request should be a priority as it controls future permit action for Mr. Kanouff’s tenants. It was noted that this issue was discussed with Mr. Kanouff before he left for the winter, but it was not mandated with a time table until April, 2016. Mrs. Emick asked if there was some way to make the granting of the permit contingent on signs being up. Mr. Thomas said he felt that Mr. Juliano should not be held hostage on his permit but unfortunately Mr. Kanouff is the owner of the property and he agreed to the time table. There was further discussion and Mr. Kanouff said there are approximately 12 streets that need signs. It was noted that at the April, 2016 ZBA hearing the board indicated that no further permits would be issued to Mr. Kanouff’s tenants until the street sign requirement was complied with.

Mr. Winger asked Mr. Levesque if he was willing to entertain a modified motion. Mr. Levesque said no. He said the board has voted and the situation is closed.
On a motion made by Mr. Levesque, seconded by Mr. Thomas and none being opposed, the hearing was adjourned at 7:20 PM.
