Mrs. Carlson brought the Public Hearing to order at 6:30 PM.

LOCAL LAW #1-2016 – SIGNS
Mr. Stapleton said that Mrs. Thomas had sent a Municipal Referral to the Chautauqua County Planning Department on both of the proposed Local Laws. He said their response had indicated that both
were matters of local concern. Mr. Stapleton reviewed in its entirety proposed Local Law #1-2016: A Local Law filing updating and amending the 1989 Town of North Harmony Zoning Code Article VI, Section 617 – Signs.
Discussion:
Mr. Stow expressed concern about household sale signs placed on off premise trees and utility poles. He said they should not be allowed. He also questioned the existence of off premise billboard when the new law indicates in Section 5.a.(1) indicates that no off premise billboards are permitted in any district.
Mr. McCord said every zoning code has a section that refers to non-conforming uses or grandfathered uses and it explains that something that existed before is grandfathered and how you deal with it.
Mr. Sena noted that the majority of the Sign Law is already in place in our zoning. He said the Planning Board has worked to update it to cover new things such as inflatable signs, banners, flags, etc.

LOCAL LAW #2-2016 – SAWMILLS
Mr. Stapleton reviewed in its entirety proposed Local Law #2-2016: A Local Law to Amend the Current Town of North Harmony Zoning Law in Regards to the Regulations of Sawmills.
Mrs. Thomas indicated that she had numbered the law Section 642 – Sawmills under Article VI: SUPPLEMENTAL REGULATIONS.
Discussion:
Mr. Stow said he would like to see provisions for onsite access for emergency vehicles.
Mr. Stapleton asked if he wanted the access to be reviewed by the fire department for suitability for fire protection.
Mr. Stow said as a former fire chief he knows that a place to get into the location and set up a portable pond and engine space will be necessary.
Mr. McNeill questioned how we would protect someone who had a small mill on their own property for their own use for many years.
Mr. Stapleton said he felt that would be covered under the definition portion related to local craftsmen, carpenters and farmers.
Additions/Corrections:
• Addition: 10. Owner/Operator shall cooperate with the Fire Department and Code Enforcement Officer to determine appropriate access lanes for adequate fire prevention and emergency vehicle service.

• MATTHEW HENRY AND MR. JOHNSON – CONCERN ABOUT STEDMAN CAFÉ AND THE CREAMERY
Mr. Henry said they have concerns about the Stedman Café and the Creamery. He said there are many cars parking on the shoulder of the road; septic issues at the café (not adequate for the type of business being operated); dumpster and garbage.
Mr. Johnson said when the café added on the deck they had pushed their ditch 25’ onto his property and when they had put in their parking lot on the other side they pushed it 20’ into his land.
Mrs. Carlson asked if they had a survey of their land.
Mr. Johnson said the café owners had their land surveyed, so they knew that they were encroaching on his property.
Mr. Henry said they had contacted the police and they had told the café to remove things and not to continue to encroach.
Mr. Johnson said they had contacted the dumpster company and asked them to move the dumpster back onto the café property but the café owners had taken a bobcat and moved it back onto his property. He said he had also contacted the Health Dept. and been told that the café has a single family septic system. He said there is a full family and restaurant using that septic.
Mr. Henry said he has photos of himself last summer standing in a foot of gray water coming from the septic at the café.
Mr. Johnson said there is a ditch on his property that goes around the café and he had been told that it is not a county ditch and is his problem. He said the café has water coming from 4 different areas that flows into his ditch.
There was further discussion of issues on the property.
Mrs. Carlson asked Mr. Lawson if this was a town issue or a private issue.
Mr. Lawson said he had spoken to the Health Dept. and they indicated that they had been at the café to review the septic and they had no issue with it.
Mr. Henry said NYS Code indicates that a restaurant must have leach field run off. He indicated that the property is not large enough to have correct distance between the well and septic and that currently as far as anything of that nature, there is just a very deep hole with gravel.
Mr. Lawson said the county is in charge of the regulation of septic systems. He said as far as the other issues, this is the first he has heard of it. He said he has been working with the café owners and they are doing a lot of renovations. He said he did not know that they were encroaching on the neighbors. He said it may be a matter for attorneys to work out.
Mr. Henry said what about the issue of patrons parking on the shoulder of the road. He said he has a 14 year old daughter with Down Syndrome who has almost been hit twice trying to go to the neighbors to play.
Mr. Lawson said that would be an issue for the Sheriff’s Dept., not the town.
Mr. Henry said the Sheriff’s Dept. has indicated they cannot keep responding to his many calls and suggested he attend a town board meeting to discuss the problem.
Mr. Stapleton said if the Zoning Board has granted them a Special Use permit to operate a restaurant and wished to review the permit that would be an option to discuss the issues.
Mrs. Carlson said the town would need to do some homework to determine if and when a permit was issued. She said she is sorry there is not an immediate answer, but the town would work on it.
Mr. Henry said in his conversations with the County Engineer, he had indicated that they needed to approach the town about their issues.
Mrs. Carlson said the road involved is a county road, not a town road.
Mr. Henry said he had contacted the NYS Attorney General’s office; NYS DEC; County Health Dept.; and County Engineers and all had indicated it was a problem for the town to handle.

Mrs. Carlson said she agrees there is a lot of congestion around the café. She said the town will look into the issue.
There was further discussion by the board. It was suggested that the neighbors might want to pull the septic file at the county on the café and have it reviewed by a contractor. It was also suggested that some type of written letter indicating whether or not the septic is adequate be sought from the contractor/expert. Mr. Henry thanked the board for their time.

Mr. Emick asked about the request.
Mrs. Thomas indicated that she had received the request and after some investigation and discussion with other clerks who had received the same request, it was determined that Smart Procures goal was to develop a client base of contractors, suppliers, vendors, which they could use to create a data base and sell to their customers. She said they had requested all electronic purchasing records from 2010 to present. She said they wanted the records in a specific electronic format which the town cannot provide. She said FOIL laws indicate that if existing records do not exist in a particular format the FOIL officer is not required to create a new record. She indicated that she had replied to the FOIL request in the proscribed time allowed.

11. FRANK STOW – CONCERN ABOUT BRIDGE SUPPORT
Mr. Stow said a couple of years ago there was an issue with a support washing out on the lake bridge. He said there is a great deal of gravel and silt building up around it.
Mrs. Carlson said when she contacted the DOT in Buffalo they indicated it was not a problem.
Mr. Chagnon asked Mr. Stow if he would take him to the location so he could look at it.

Mrs. Carlson suggested that once the audit is complete, the board will better understand the procedure is so that it can be done in house.
Mr. Stow said he would like to look into having another town review our court books in exchange for reviewing theirs.

• VETERANS MEMORIAL MEETING – THURSDAY. 4/14/16 AT 10:00 AM

PIERRE CHAGNON, LEGISLATOR
Mr. Chagnon said the following had occurred at the March, 2016 Legislature meeting:
The legislature tabled a local law proposal to prohibit the sale of cigarettes, cigars, chewing tobacco, powdered tobacco, shisha, bidis, gutka, other tobacco products, nicotine water, herbal cigarettes, electronic cigarettes, liquid nicotine, snuff, rolling papers, and smoking paraphernalia to persons under the age of 21.
Mr. Chagnon asked the board for any input on how they wished him to either support or not support this law.
There was discussion and it was generally agreed that although smoking is not good for your health, if someone can vote, fight and die for their country at the age of 18 they should be able to buy a pack of cigarettes. There were questions about enforcement effectiveness.
The Legislature authorized hiring a lobbyist to advocate for Federal projects and funding for much needed maintenance dredging and rehabilitation of breakwaters at Chautauqua County’s shallow draft recreational harbors in Barcelona, Dunkirk and Cattaraugus Creek. Projects such as these are undertaken by the United States Army Corps of Engineers, and are of low priority when compared to large deep draft commercial harbors with significant shipping tonnage. As a small rural county, we are at a distinct disadvantage with respect to our ability to advocate for our fair share of federal funds, so we are retaining the professional services of a consultant specializing in water resources, programming, federal projects and obtaining federal funding on a six-month trial basis at a cost not to exceed $15,000. The Lake Erie Management Commission will provide $5,000 and the Country will provide $10,000 from the 2% Occupancy Tax reserve.
KEVIN OKERLUND, ASSESSOR
Mr. Okerlund’s report indicated that the tentative roll will be filed on 5/1/2016. The report indicated that gas well production values have fallen from 9.54/mcf in 2012 to 1.82/mcf this year. Well assessments have dropped from approximately $2,394,000 in 2012 to $1,245,000 last year and an additional drop is expected this year.
Mrs. Carlson said Mrs. Thomas is attempting to get sales dollar figures as they were left out of the monthly report for February.

DAN STRICKLAND, HIGHWAY SUPERINTENDENT
Mr. Strickland said as soon as weather permits they would be doing patching and oil and stone. He said they also planned to do some nova chip in the bays (Hadley, Conolly Park, Almar, Longview, Neits Crest, and Ashville Bay). He said there should be plenty of funds due to the extra $31,000 from CHIPS to do that work. He said they have surveyed the signs in the town and have ordered some.
Mr. Whitney commented that Dan Brown of Pine Hills Motels said the highway department had come and done some cleaning and work on the road edges and they were very pleased. Mr. Whitney asked about the condition (turn in is covered with deep holes) of the Hadley Bay Road to the credit union. He asked if we had to wait for the state to do that or could the town do that.
Mr. Strickland said he doesn’t know if the state will do that when they work on Rt. 394. He said usually he starts work on a road where the state leaves off, but if necessary they could at least patch the holes.
HOWARD PEACOCK, JUSTICE (Copy of Report in Minute Book)
Mr. Peacock read the March, 2016 Justice Report for those present. He read a note from Court Clerk, Vickie Stow and Katie Zimmer that indicated that the large volume of cases they are handling seems to have become the new normal and even the winter months during which there is historically a slowdown has kept them extremely busy with a larger number of cases than in the past.

Mr. Lawson gave a review of his report for those present. He indicated that the Planning Board will review 2 sketch plans at their meeting tomorrow night. He said he would contact the County Health Dept. about the issue with the Stedman Café which was discussed previously in the meeting. He said these two neighbors have had issues for many years. There was further discussion of concern about health issues with a restaurant operating with a water source so close to a septic tank. It was suggested that maybe a higher efficiency septic system needs to be installed.
BRAD LAWSON, AFD COMMISSIONER
Mr. Lawson said 4 new members were recruited this month which is very exciting. He said the new radios are in some of the new vehicles. He said the portables are the issue now. He said they will be going to high band instead of low band and hopefully things will be coming together soon.

Mrs. Thomas said she had spoken to Mike Masters about surveying Butts Park and he had given her a ballpark price of $1,500 – $2,000 to do the work. It was noted that a motion had already been passed to have the survey done at the March meeting. She said the last day of tax collection was 4/1/2016 and gave a report of collection’s (copy of tax report attached to minutes).

Mrs. Carlson said she has been attending county meetings to see if there are additional ways to save money through Shared Services. She said they are investigating an insurance pool for health care coverage.
