Mr. Levesque brought the hearing to order at 7:10 PM. Mr. Stapleton swore in all who expressed intent to speak regarding the case before the board.
1. Todd Feldt requesting a Special Use Permit to place a double wide manufactured home on a pier foundation at property located at 5772 Cheney Rd., Ashville, NY, Specifically Sec. 348.00-2-13.2.
Howard Feldt appeared to represent Todd Feldt. He said they would like to install a new 26’ x 52’ manufactured home on a vacant parcel. Mr. Lawson said the only reason the case is before the board is that the home will be placed on piers and that requires a Special Use Permit. He said if it were on a perimeter foundation the action would be by right in that district. Mr. Lawson said silt fencing and all other requirements will be met. There was discussion and Mr. Feldt assured the board that vinyl skirting would be installed around the home. Section 629 of the Zoning Code was reviewed and all criteria were met with the exception of the perimeter foundation. Mr. Levesque asked if anyone had any questions regarding the application.
Mr. Levesque motioned to grant a Special Use Permit to Todd Feldt to place a double wide manufactured home on a pier foundation at property located at 5772 Cheney Rd., Ashville, NY, Specifically Sec. 348.00-2-13.2 as outlined in the application and in the minutes above with the following conditions:
• Skirting to be installed within one week of installation of the unit
• Shrubbery to be planted according to zoning code requirements
Mr. Thomas seconded. The motion was carried unanimously.
2. Letter from Paladino, Cavan, Quinlivan & Pierce dated 8/10/15 regarding application of Paul Lamparelli requesting a Special Permit to refurbish old church camp dorm into a habitable space located at 3736 Victoria Rd, Ashville, NY, Section 332.06-1-10.1.(Old#18-3-2) (Reference ZBA Minutes dated 6/24/2015).
Mr. Levesque indicated that the letter was asking the ZBA to reconsider their decision on the Lamparelli request. There was discussion by the board that the reason the request was denied was that it would be permitting two dwellings on one lot as there is already an existing home on the property. There was discussion of the previous hearing and the request.
Mr. Levesque motioned to reconsider the application of Paul Lamparelli requesting a Special Use Permit to refurbish old church camp dorm into habitable space located at 3736 Victoria Rd, Ashville, NY, Section 332.06-1-10.1.(Old#18-3-2). Mrs. Ortman seconded. A roll call vote was taken. Yes (0). No (5): Levesque, Emick, Michalak, Thomas, Ortman. The motion was unanimously denied.
