Pat Rice opened the meeting at 7:00 P.M.
Don McCord started the meeting with the Town Board and Planning Board to discuss the Subdivision Law of the Town of North Harmony.
Don McCord proposed that Subdivision laws are stand alone laws within the town code. These laws will play a role in partnering together with the zoning code, but will not be incorporated with zoning. The underline plats are created to conform to the zoning law. The idea of this law is to protect your tax space, making sure that the land is divided efficiently. This includes getting the most lots, best tax base, protecting future citizens, Highway / Fire Department and all people related to what the town does and services it provides.
This law is an 80% technical guide series of N.Y.S. The state will allow municipalities to decide a major/minor subdivision.
Discussions on Minor Subdivision review procedures include:
- Applicant has to submit final minor plat at least 14 days prior to the meeting at which it will be considered by the planning board. This will avoid having the applicant come before the board without proper information.
- Planning Board is to approve/deny the proposed plat within 62 days. If the applicant doesn’t have a satisfactory package the 62 days will not start.
The intent of the language in this law is to make it simple with a protective mechanism for the lots. This will help owners in the future, preventing any disputes.
Dave Stapleton added that the efficient division of land within the Town of North Harmony will benefit the town in many ways. In the future it will prevent problems when a piece of land is divided. Sally Carlson and Brad Lawson appreciate the guidelines/drawings of this law and agreed this will make it easier to understand the process and details to plats.
Richard Sena suggested posting meetings of public hearings on the town website.
Pat Rice closed the meeting with the following:
- adjust the language on pages 32&33, regarding the sale of subdivision lots approved by the Department of Law of the State of New York.
- use proper language for Highway specs.
