SEQR REVIEW:
Mrs. Carlson opened the hearing at 6:30 PM.
Mr. Stapleton said a full EAF had been completed for proposed Local Law No. 1-2014. He said
Mrs. Thomas indicated that she had sent a Municipal Referral to the County Planning Dept. and had received
a letter back that the proposed local law is a “matter of local concern”. He said there had been a chance to
review the law at the previous board meeting and there were a few requested minor changes/spelling
corrections noted that will be incorporated by Mr. McCord. Mr. Stapleton said the DEC is now using a new
EAF that is a little different. He said since we are not dealing with a specific project but a legislative action,
there are questions in Part 1, Project and Setting that are exempted (items D. and E.). Mr. Stapleton
reviewed in its entirety Part 1, Project and Setting.
The following additions/corrections were made:
- Part 1: Page 3; C.4.d. Addition of Lighthouse Park, Ashville Commons, Veterans Park
Mr. Stapleton reviewed Part 2, Identification of Potential Project Impacts in its entirety for those
present and all were answered with a “No” response.
Mr. Stapleton said Part 3 is the Evaluation of the Magnitude and Importance of Project Impacts and
Determination of Significance. - MOTION #66 OF 2014
MR. SENA MOTIONED FOR A NEGATIVE DECLARATION OF IMPACT ON THE SEQR FOR
LOCAL LAW NO. 1-2014, UPDATING AND AMENDING THE 1989 TOWN OF NORTH
HARMONY ZONING CODE. MR. MCNEILL SECONDED. AYE (5): WHITNEY, STOW, SENA,
MCNEILL, CARLSON. NO (0). THE MOTION WAS CARRIED.
PUBLIC HEARING:
Mr. Stapleton asked that all of the discussion at the May meeting regarding the updating/amending
of the Zoning Code be incorporated into this public hearing. He said Mr. Sena had some suggested changes.
Mr. Sena said the changes had been discussed at the previous Planning Board meeting and they were
minor.
Mrs. Thomas said she had contacted Mr. McCord and he advised that the Planning Board had
approved some of the changes, but not all of them. Items discussed were:
- Section 105 (pg. 10) – Application of Regulations item 8. Excavation and Utility Lines correct
spelling on “contractor”; add: notify “811 Call Before You Dig” - Definitions (pg. 17) Cluster Development; correct spelling of district by removing extra “t”
- Definitions (pg. 26) Shooting Range; add rifles and pistols to shooting range
- Section 615b. (pg. 79) Parking space size is 9’ wide by 19’ long
Mr. Stapleton asked if there were any questions regarding the law.
Mrs. Carlson closed the public hearing at 6:23 PM.
